Same Sex Civil Unions
On January 31, 2011 Illinois Governor Patrick Quinn signed into law the civil union legislation that granted same sex couples similar rights as married couples.  Illinois' civil union law differs, in part, from bankruptcy law, in that bankruptcy law is a federal law while the Illinois civil union law is a state law.

How does the Illinois Civil Union law affect my ability to file bankruptcy?  The Illinois Civil Union law does not apply to bankruptcy law.  It does not affect your ability to file bankruptcy one way or another.

Can a same sex civil union couple in Illinois file a joint bankruptcy case?  No, the Federal Defense of Marriage Act prevents federal courts from recognizing same sex marriages or civil unions granted under state law.

Can a same sex civil union couple in Illinois file bankruptcy?  Yes, but each person must file an individual case instead of both filing a joint case together.

Can only one person to a same sex civil union in Illinois file bankruptcy or do both persons have to file?  One partner in a same sex civil union in Illinois can file bankruptcy alone and the other same sex civil union partner does not have to file.

Are there any rainbow friendly bankruptcy lawyers who represent the gay, lesbian, bisexual and transgender community?  Yes, Illinois bankruptcy attorney and lawyer Andy Miofsky represents gay, lesbian, bisexual and transgender clients without discrimination.  Dammit, it's the right thing to do.
